Welcome to TrimTab Fit. These Terms and Conditions ("Terms") govern your use of the TrimTab Fit mobile application (the "App") provided by TrimTab Fit ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.
To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to update it as necessary.

You should consult with a qualified healthcare professional before beginning any diet, exercise, or wellness program. You acknowledge that you use the App's recommendations at your own risk and that we are not liable for any health-related outcomes resulting from your use of the App.
The App includes an AI-powered coaching feature that provides personalized suggestions based on your data and goals. You understand that:

You may submit content through the App, including recipes, profile information, and community posts ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content within the App and its community features.
You are solely responsible for your User Content and represent that you have the right to share it. We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.
The App and its original content, features, and functionality are owned by TrimTab Fit and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the App settings.
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, TrimTab Fit and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, whether based on warranty, contract, tort, or any other legal theory.
You agree to indemnify and hold harmless TrimTab Fit and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your User Content, or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
We may revise these Terms at any time by posting the updated version within the App. Material changes will be communicated through the App or via email. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
